The below disclosure only applies if you (You) are a consumer (as defined by the Australian Consumer Law) and are receiving the supply of goods or services from Hockey Stick Advisory Pty Ltd (ABN 60 659 210 894) (HSA) within the state of New South Wales, Australia.
Before You enter into the Terms of Use with HSA (Agreement), HSA draws Your attention to the following terms and conditions (in summary form) which are contained in the Agreement:
(a)HSA may immediately terminate the Agreement upon notice to You.
(b)HSA may collect and compile data, statistics and information in aggregated and anonymised form based on the data you input into HSA's software. Such aggregated and anonymised data may be used by HSA for any purpose and may be disclosed to third parties.
(c)HSA excludes its liability to You for certain categories of loss or damage such as indirect or consequential losses, loss of data and loss of profits (among others).
(d)HSA' liability to You for direct losses is limited.
(e)You must indemnify HSA against loss and damage in certain circumstances (such as where Your data breaches applicable laws or You infringe HSA's intellectual property rights, among others).
